General terms and conditions of use of the Staff & Go e-Coffre

Definitions

GCU: General Conditions of Use for Staff & Go e-Coffre Services

Documents: various documents (employment contracts, DPAE, letters to the mutual insurance company) issued via the Staff & Go Solution or documents that you yourself have uploaded to Staff & Go e-Coffre.

Personal Data: any information likely to identify you directly or indirectly.

Staff & Go e-Coffre: is an electronic strong-box, this offer secured storage space allocated to You by Digidiz.

GRPD: General Regulation for the Protection of Personal Data.

Data controller: the legal entity or natural person who determines the purposes and means of a processing operation, i.e. the objective and the way in which it is carried out.

Services: services provided by Digidiz in connection with the use of the Staff & Go e-Offer.

Sub-processor: natural or legal person who processes data on behalf of another organization (“the data controller”).

You: User of the e-Coffre Staff & Go.

Preamble

The Staff & Go e-Coffre is a service (“Service”) provided by Digidiz SAS which enables its user (“you”) to electronically archive, in a secure area, personal Documents such as diplomas, identity papers, driver’s licenses, etc. If your employer uses the Staff & Go software, you will also be able to access employment contracts, amendments and pay slips issued by this same employer.

The creation of a Staff & Go e-Coffre account and the use of services after having been notified of the modification to the present conditions constitutes acceptance of these General Conditions of Use (hereinafter referred to as “GCU”).

These GCU apply, without restriction or reservation, to all Services provided by Digidiz on the https://app.staffngo.com/ website. Their purpose is to determine the rules governing the use of the Staff & Go e-Coffre published by Digidiz SAS.

Article 2 - Use of the Staff & Go e-Coffre

Digidiz grants you a personal, non-exclusive, non-assignable, and non-transferable right to use the functionalities of the electronic strong-box aka Staff & Go e-Coffre.

You will be able to access:

  • Documents sent by your employer or future employer (employment contract, pay slips), if they have subscribed to Staff & Go;

  • Documents and Personal Data that your employer may request as part of your recruitment or professional activity.

  • Documents that you yourself have uploaded to your Staff & Go e-Coffre .

Digidiz undertakes to use its best efforts to provide You with the Services, on a best-efforts basis.

Registration is free of charge, but requires acceptance of the Terms and Conditions and subscription by your employer to the Staff & Go offer.

Storage capacity is limited to 1GB.

You acknowledge that the personal right of use granted in this article does not give you any right of ownership over the Staff & Go e-Coffre , Staff & Go and the elements of which they are composed, which are and shall remain the exclusive property of Digidiz.

Article 3 - Technical requirements and maintenance

In order to take full advantage of the Services provided, You must have a high-speed Internet connection (ADSL or Fibre).

You acknowledge that you are aware that the Staff & Go e-Coffre is accessible and usable only with the Google Chrome browser (version 84.0.4147.135 and later) and the following operating systems: Microsoft Windows (Windows 8 and later), Mac OS (10.10 and later) and Linux.

You acknowledge that you will need to regularly update this browser and these operating systems in order to fully use the Staff & Go e-Coffre.

This being the case, your access to the Staff & Go e-Coffre may occasionally be suspended or limited to allow for repairs, maintenance operations, or to add a new feature or service to those already offered.

Digidiz reserves the right to freely develop the Services, in particular for legal or technical reasons, in order, for example, to create new functionalities or improve existing functionalities.

Article 4 - Responsibilities of Digidiz

Digidiz is a technical solution provider that allows you to archive or store your Documents. It also allows you to share your Personal Data with your employer, if the latter has subscribed to the Staff & Go offer.

As a general rule, Digidiz may only be held liable in the event of proven fault or negligence and is limited to direct damage to the exclusion of any indirect damage of any nature whatsoever.

Digidiz shall not be held responsible or liable for any delay or non-performance resulting from an event of force majeure as defined in Article 10 of these GCU.

Digidiz may not be held liable in the event of failure to comply with the legislation of a country other than France in which the Services may be provided. You, who are solely responsible for the choice of the Services requested, are responsible for verifying the content of said foreign law and the validity of the Services with respect to said law.

Digidiz is in no way responsible for the data and Documents it hosts. You are responsible for the information you enter and the Documents you store or archive in the Staff & Go e-Coffre.

Article 5 - Your responsibilities

By registering for the Staff & Go e-Coffre, you undertake to

  • to provide accurate, truthful and up-to-date information. You are solely responsible for the quality of the information entered and for the consequences of the obsolescence or inaccuracy of this information. Digidiz shall not be held liable.

  • Not to store any illicit data or documents, such as child pornography, terrorist content, etc.

Article 6 - Changes to the GCU

The GCU applicable are those in force at the date of connection to and use of the Staff & Go e-Coffer.

Digidiz reserves the right to modify these GCU at any time without prior notice or information. The applicable GCU will be systematically made available to you in the Staff & Go e-Coffre. These provisions will be deemed to have been accepted immediately. We therefore invite you to regularly consult the GCU available in the Staff & Go e-Coffre.

Article 7 - Cancellation

Cancellation at your initiative

You may cancel your contract at any time. The request must be made to the following email address: contact@digidiz.eu

Digidiz will invite you to download your Documents before deleting them. You will then lose all the rights granted to you when you registered for the Staff & Go e-Coffre. You must also notify your employer of the deletion of pay slips and employment contracts archived in yourStaff & Go e-Coffre.

Termination by Digidiz

The Agreement may be terminated by Digidiz in the event of a serious breach of your contractual obligations, one (1) month after the sending of a formal notice email requesting you to remedy the said breach, and indicating the intention to apply the present clause.

A serious breach on your part is defined as :

  • violate the article relating to intellectual property,

  • violate the article relating to personal data,

  • violating the article relating to Your responsibilities

Depending on the seriousness of the breach, Digidiz reserves the right to suspend your access or terminate your contract without delay.

Article 8 - Intellectual property

The content of the www.app.staffngo.com site (trademarks, texts, photos, data, etc.) is the property of Digidiz and is protected by French and international laws relating to intellectual property.

As such, you may not act on these elements, and in particular you may not reproduce, represent, adapt, translate and/or transform, in whole or in part, or transfer to another website, any element comprising the website without the prior written authorization of Digidiz. Any unauthorized extraction and/or reuse of these elements may result in civil and criminal penalties.

In general, the use of the Services does not give you any right to the patents, trademarks and other industrial or intellectual property rights held by Digidiz.

Article 9 - Personal Data

Digidiz implements organizational, technical, software and physical digital security measures to protect personal data against alteration, destruction and unauthorized access. However, the Internet is not a completely secure environment and Digidiz cannot guarantee the security of the transmission or storage of information over the Internet.

You are responsible for taking all necessary steps to ensure the security of access to your account, including the use of passwords that are unique, personal, strong and kept strictly confidential.

You acknowledge that Digidiz may not be held liable in the event of fraudulent access to the Staff & Go e-Coffre due to a defect or security breach resulting from carelessness, error or omission on your part.

The Privacy Policy is detailed in the “Privacy Policy” document accessible from the Staff & Go e-Coffre and approved when registering for the Staff & Go e-Coffre.

Article 10 - Force majeure

Digidiz shall not be held liable if the non-performance or delay in the performance of any of its obligations as described herein results from an event of Force Majeure, within the meaning of article 1218 of the French Civil Code.

By express agreement, the following events constitute Force Majeure within the meaning of this Contract, without this list being limitative: fire, flood, bad weather, natural disasters, earthquakes, acts of terrorism, armed conflicts, riots, interruptions or delays in transportation, labor disputes relating to personnel (strikes in any form whatsoever, lock-outs), including for either Party, acts of authority or “fait du prince”.

Epidemics and pandemics are also considered as Force Majeure events, in the event that they give rise to the establishment, by a French or foreign authority or jurisdiction, of a period of health emergency, or to the implementation of restrictions of any kind whatsoever on the performance by either Party of its activity.
